			<description>&#60;p&#62;I'm having a hard time trying to decide what I need to do. My current (new manager) manager. Was hired but the DM and he have been long time friends and ran a similar type of company together....we were terribly understaffed when he started and I had read a bunch of memos about hiring friends and receiving a 100$ bonus. I offered plenty of suggestions and all were turned away with ought even one glance. He told me it would be unprofessional  for me to work with my friends I'm a simple barista so its not like its a conflict of interest...2 months later he hires 5 people. All of them were friends of his. I'm talking more than acquaintances... they get drunk together sleep at eachothers houses hit the clubs that kind of thing. One of them is constantly late and hung over. Never written up or even repremanded. Some of us have found through the portal that the manager fixes this particular employees clock ins to being (on time) a total of 30 and rising. Also not to be prejudice I'm all for the gay community, I've had my share of same sex action. But they are all bi-sexual or gay...he said &#34;I'm going to gay up starbucks &#34; its nit that there gay that bothers me .its that its one of the reasons he's hiring them that bugs me. We waited a good 4 months for our reviews we figured he needed to work with us gave him some space...did our thing and when they finally came around there all crap..I understand the things I missed being wrong but the things I'm great at..absolutely drives me insane. I barely work with the manbut he didn't know a thing about me. I'm fairly week in bean knowledge..but cleaning is my strong hold. He gives me a 2 in bean knowledge  I get that..he said I never have to worry about the close being wrong with you, its always perfect and yet I get a 2 unexplained. Even tho I'm perfect with it.  Also on customer basis. I always come to work happy, i love the energy and the environment. Pkus i love a challenge, a busy day and getting everything done. Everyone leaving satisfied and the compkements i get on my drinks, yet he gives me a 2 saying i sound boring like barry white. Sure I'm agry about that..for me it was the last straw. He's trading our tips between the registers when that money is never supposed to touch iit. The orders are completely wrong and not to mention the schedules..its getting overwhelming and I used to love my job. Look forward to being tthere but its going too far and I want to leave but I'm going to file on this idiot I just need some help I don't know where to start or what's legit in a case I'm only 20..mother and can't afford not to have a job. But my rights need to be met.

			<description>&#60;p&#62;Just a note to all of you---I have just completed an affidavit for a barista who was recently fired after working for the BUX for over 7 years and is suing the manager and the BUX for wrongful termination. How, after 7 years, does a new manager suddenly find this barista so &#34;wrong&#34;? Maybe it has something to do with certain social differences and weight differences. I sure hope she gets mucho $$ and satisfaction over a the potential for a disgraced manager. I am retired and worked for the BUX for about 3 years and 2 managers before meeting up with this manager who is one of &#34;those&#34; managers all of you seem to talk about. After several differences of opinion, I told her to just take the job and shove it--in the middle of my shift I took the prestigious green apron off, dumped it on the floor and walked out without saying a word. I miss the customers with whom I had a personal connection and the baristas who work very hard for very little but I do not miss that garbage they call manager and I do not miss the BUX at all. I drink a mix of Chock Full of Nuts and 8 O Clock and enjoy it. The VERY reduced cost is a real plus. Then again all I do now is open my retirement check and my social security check and enjoy life; the time spent at the BUX is now crowded with a morning walk, exercise at a health club, and some hobbies.

&#60;p&#62;I have also noticed that she has a tendency to fire the very few African American partners we have.  Another partner said she did the same thing at another store.  But I can't prove it because it has nothing to do with me.  She tried really hard to fire a friend of mine who was a great worker, again, for totally bogus reasons.  Friend called human resources and they never even returned her call.  &#60;/p&#62;
&#60;p&#62;I contacted a friend of mine in another district and got her transferred before the manager could actually fire her and not even 2 months after she transferred to her new store she was promoted.  I find it odd, inconsistent and unfair.  &#60;/p&#62;
&#60;p&#62;But again, it didn't happen to me.  Just sucks to see a friend have to go through the same hell that I do.  At least she escaped, right?

&#60;p&#62;The official policy is based on how severe the infraction is.  Some things require immediate termination.  Others require conversations followed by corrective actions.  There is no final &#34;magic&#34; number, but it most often goes like this....coaching conversation, verbal warning(with written documentation of said warning), written warning(corrective action), final written warning, separation.  This is usually all about one behavior, but sometimes several related behaviors can be lumped together to provide aas much proof as possible that separation is necessary.&#60;/p&#62;
&#60;p&#62;It isn't very easy to figure out, I'll admit.  I can't make it any more clear....lol!  I think it is intended to give SMs enough room to work with partners on a variety of issues, in order to make them better at what they do.  Too often it is applied inconstantly or improperly. I wish I could be of more help.&#60;/p&#62;
&#60;p&#62;I do find it strange that PR and the DM aren't more interested/involved in this situation.

It all depends on how she spins it, in all honesty.  As for the write ups you've been given that do not state what policy or procedure are not properly prepared.  And that is where I'd start the internal investigation with Partner Resources. &#60;/p&#62;
&#60;p&#62;I'd tell them that part of the reason you cannot get on the same page as your SM is that she is so unclear in her corrective actions!  If you don't know what policy or procedure you broke, how can you avoid doing it again, in the future?  You might even claim that she is being deliberately vague in order to get you in trouble.

&#60;p&#62;An example of one of my corrective actions: I do not agree with the new till audit procedure.  I believe that the partner should be involved in the process and witness the manager counting out the till.  It begs for dishonesty on the part of management.  My manager could not answer my query about what to do if a partner is not comfortable with that policy and told me to &#34;reach out to other resources&#34;.  Okay, other shift supervisors are resources, right?  Says it right in the manual.  I asked my fellow supervisors if they were comfortable with the process.  I never said anything negative or personal about the manager. Just that I thought it was not fair to not witness your own till audit.  I got written up for that conversation.  Only me.  The other two supervisors were not reprimanded. And I don't even know what policy/behavior I violated and the corrective action does not state it (i.e. insubordination, composure..)  &#60;/p&#62;
&#60;p&#62;And I have a couple others that are similar.  I was actually told that I take too long in the bathroom!  What??  &#60;/p&#62;
&#60;p&#62;I can't make this stuff up.&#60;/p&#62;
&#60;p&#62;I have spoken to an attorney but I concluded that letting an outside agency investigate on my behalf was a more objective and financially reasonable option.  &#60;/p&#62;
&#60;p&#62;About the issue of confidentiality:  Quite a while ago I confided in my manager that my husband could possibly be deployed and I wanted to give her ample time to allow me to take time off.  I explained that what I was telling her was considered sensitive information and I did not want to put my husband's military career at any risk, no matter how big or small.  Next shift I work, the partner I filed the sexual harassment complaint against, walks up to me and says &#34;so I hear your husband is going to Iraq&#34;.  &#60;/p&#62;
&#60;p&#62;What tact, right?  When I confronted the manager about it, she flat out lied and said that I never let her know it was confidential.  Wow.  &#60;/p&#62;
&#60;p&#62;Anyway, I could write a novel of all the horrible things that I have endured at that store.  I'm just trying to give you a better sense of what/why I am seeking advice and help.  So anything that you can offer is greatly appreciated =D

As you are taking note of the instances in which you're being obviously discriminated against, any attorney will have a strong case to work with. Perhaps a little &#34;honest press&#34; will get the Bux to straighten up.&#60;br /&#62;
I'm glad you're sharing your story with others-that way fellow partners know they're not alone in their struggle.

			<description>&#60;p&#62;Ok....there is no specific number of corrective actions that lead to separation.  It can only take one, based on the severity of the offense.  &#60;/p&#62;
&#60;p&#62;A partner could have many corrective actions, say 12, and still be in good standing.  How?  Well, according to the rules, a corrective action is to put the partner on notice of the consequences if the offense occurs again or the noted behavior doesn't change.  So, if you don't do whatever got you written up that time, things are just hunky-dory.  &#60;/p&#62;
&#60;p&#62;That being said, if you get written up for the same behavior over and over, it will lead to a separation.  At any point....it could be 2 more corrective actions, it could be 4.  It depends on the frequency of the offense, how long between episodes, prior warnings or conversations, etc.&#60;/p&#62;
&#60;p&#62;As for a time limit, corrective actions do have an &#34;expiration date&#34;, though I cannot remember the exact amount of time.&#60;/p&#62;
&#60;p&#62;I would make a complaint about the possible sharing of confidential information, as illustrated by the incident you mentioned above.  It, again, goes back to providing a great work environment and treating each other with respect and dignity.  It would be inappropriate for a manager to tell someone else about an impending firing.  That little joke about your partner numbers was very rude and hurtful...not funny at all.

			<description>&#60;p&#62;I wouldn't expect any partner (DM or otherwise) to divulge confidential information like that.  It just amazes me what some managers can get away with.  My manager seems to turn on the water works and cry her little eyes out anytime she has to have a serious &#34;sit down&#34;.  Whatever works, I guess.  &#60;/p&#62;
&#60;p&#62;I'm glad that there are managers out there (such as yourself) who understand the importance of respect in the workplace.&#60;/p&#62;
&#60;p&#62;Do you happen to know what the exact policy is for the amount of corrective actions a partner can have before separation?&#60;/p&#62;
&#60;p&#62;I was told by my manager that after 3 months the corrective actions are basically null and that there has to be at least 3 corrective actions that show a pattern of behavior.  Example: partner was late more than 3 times within 3 months.  But I can not find that policy in writing.  &#60;/p&#62;
&#60;p&#62;Also, partners make really rude comments toward me that indicate that my manager has told partners that I am going to be fired.  Isn't that confidential information?&#60;br /&#62;
Example: I asked a co-worker to mark out my partner beverage and the partner punched in my number and said &#34;uh oh - partner not recognized&#34; and then the partner and manager started laughing.  WTH??  And of course, I want so badly to just tell both of them off, but I have to hold my tongue because it's the right thing to do.  If anything, this job has taught me how to be extremely patient.

			<description>&#60;p&#62;I don't believe it is just for show.  It happened with the previous manager at my store, and she ended up fired(for not taking the correct action when a partner was sexually harassed.)&#60;/p&#62;
&#60;p&#62;I have seen cases that didn't end so spectacularly, when the DM and PR developed some sort of plan or even gave the SM a corrective action....but the partners don't really get to know the end result, as it wouldn't be fair for the DM to tell the store team the SM got written up.  They just say, &#34;It has been taken care of.&#34;

			<description>&#60;p&#62;This is why I had to go to the e.e.o.c.  But I will be long since fired by the time I even get an investigator assigned to my case.  &#60;/p&#62;
&#60;p&#62;I wish I knew why upper management continues to allow this behavior to continue.  But it seems far too common.   &#60;/p&#62;
&#60;p&#62;Isn't it pretty serious if the DM and an HR rep have to have a meeting to figure out what is going on with a manager?&#60;/p&#62;

			<description>&#60;p&#62;Well, I do know that if a partner finds talk like that uncomfortable and has said so, there is reason for a complaint, in my opinion.  I will say that partners who have known each other for a long time do tend to have some inappropriate conversations on the floor.    They usually just need a reminder to tone it down.&#60;/p&#62;
&#60;p&#62;What I can say, without a doubt, is that one of our guiding principles is to &#34;Provide a great work environment and treat each other with dignity and respect.&#34;  That should be what you complain about, in addition to harassment.  Every single time it occurs, your SM is failing to provide the above for you...and possibly some other partners or customers who do not speak up.
